1. Introduction

Welcome to Swell Adventures! These Terms & Conditions ("Terms") govern your use of our website and the booking and participation in our surf trips. By using our services, you agree to be bound by these Terms. Please read them carefully.

2. Bookings & Payments

• To secure your spot on a trip, a deposit is required. The amount usually depends on the destination.

• The remaining balance is due 1 week before the trip start date.

• We accept payments with Stripe, Bank transfer, PayPal - soon more available options.

• While we strive to maintain our listed prices, they are subject to change due to unforeseen circumstances (e.g., currency fluctuations, increased supplier costs). You will be notified of any price changes before your final payment is due.

3. Cancellations & Refunds

• If you cancel your trip, the following refund policy applies:

a.  Cancellation by You:

• If you cancel your trip more than 60 days before the trip start date, you will receive a refund of your trip cost, less the non-refundable deposit.

• If you cancel within 30 days of the trip start date, we will refund you 50%.

• All cancellations must be made in writing (email is acceptable) and are effective upon our receipt.

b. Cancellation by Swell Adventures:

• We reserve the right to cancel trips due to unforeseen circumstances (e.g., natural disasters, insufficient bookings, safety concerns). In such cases, a full refund will be issued.

• We are not responsible for any expenses incurred by you in preparation for the trip (e.g., flights, visas, vaccinations). We strongly recommend purchasing travel insurance to cover such eventualities.

4. Liability Waiver & Safety

• Surfing and travel involve inherent risks, including but not limited to: changing ocean conditions, marine life encounters, physical exertion, and travel-related risks. By participating in our trips, you acknowledge and accept these risks.

• To the fullest extent permitted by law, Swell Adventures, its guides, instructors, and partners are not liable for any injuries, losses, or damages incurred during the trip, whether caused by negligence or otherwise.

• We strongly recommend that you obtain comprehensive travel insurance that covers trip cancellation, medical expenses, personal liability, and lost or stolen belongings.

5. Participant Responsibilities

• You are responsible for your own health and fitness. You should be in good physical condition and have the necessary surfing skills for the trip you choose.

• You are expected to follow the instructions of our guides and instructors, and respect local customs and regulations.

• Any disruptive or inappropriate behavior may result in removal from the trip without refund.

6. Intellectual Property

• All content on the Swell Adventures website, including images, text, and logos, is protected by copyright and other intellectual property laws.

• You may not reproduce, distribute, or modify any content without our prior written consent.

7. Governing Law

These Terms are governed by the laws of Brazil. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Brazil.
